Students Rights Acknowledgement
I have the right:
- To review the Conduct Rules and Regulations accessible in the Student Code of Conduct by visiting the following: Student Code Article 5.
- To expect confidentiality to the extent permitted by the Family Education Rights and Privacy Act (“FERPA”) and to waive that confidentiality in writing if I choose. (Please be advised that pursuant to FERPA exceptions, some confidential information may be disclosed withoutconsent, e.g. case of health and safety emergencies).
- To consult with an advisor if you are facing suspension for ten or more days.
I understand that:
- If I am a graduate student, The Office of Student Conduct and Community Standards (OSCCS) has an obligation to inform the Graduate School of Studies of a student code violation. The Graduate School may choose to set interim measures during the course of their investigation and may request to handle the incident through their process.
- If I have additional questions, I may contact OSCCS at (435) 797-3137.
- I will receive important, time-sensitive information from OSCCS: via email, telephone, and/or postal mail.
- I am responsible for this information, that it is my responsibility to inform OSCCS of any change in my local address or phone number, and that failure to do so may result in OSCCS correspondence being sent to my permanent address on file at the Office of the Registrar.
I understand that:
- Prior to meeting with the Conduct Officer, I will be provided with a written Notice of Allegations.
- If I admit to a violation during the meeting with the Conduct Officer, we will discuss an appropriate educational and disciplinary outcome.
- The standard of proof is a "preponderance of the evidence," meaning "more likely than not," or "50%, plus a feather."
- If the Conduct Officer believes a sanction is needed, I will be informed.
- If I agree to the proposed sanction, I will sign the Responsibility and Sanctioning Agreement. This will end the process, and I will therefore end my right to a hearing or appeal.
- The Conduct Officer may choose to refer the case to a Hearing Board for a decision, notifying the board's chair right away.
- If a hearing is scheduled, I will be notified of the time, date, and location.
- I may be able to appeal the outcome based on the outlined process in the Student Code.
- If I am found responsible, then that will be reflected in my record.
- All disciplinary records are protected to the extent permitted by law.
