Weapons on Campus

Utah Code 53-5a, section 102.2, allows an individual 21 years of age or older to conceal a dangerous weapon at an institution of higher education without a concealed carry permit. Individuals aged 18 to 21 years must have a provisional permit issued by the State of Utah.

Individuals who have a provisional, temporary, or regular concealed carry permit from Utah or another state may still conceal carry on campuses.

Please note that on or about the premises of a public or private elementary school, no one may carry a firearm in any manner. This includes USU's elementary school,  preschool, and daycare programs.

An individual 21 years old or older without a concealed carry permit may not open carry a firearm in any manner on the premises of an institution of higher education. On duty, local, state, and Federal law enforcement officers are permitted to open carry.

The law also permits universities to adopt policies that allow students living in on-campus housing to request roommates who do not possess firearms in the residence.

Frequently Asked Questions about Firearms on Campus

Who may carry a concealed firearm on University property?

  • Individuals who are 21 and older, and who are not otherwise prohibited from carrying a weapon, may carry a concealed weapon on campus with or without a concealed carry permit (CCP). Utah Code Ann. §§ 53-5a-102.2
  • Individuals who are 18 to 20 years of age, and who are otherwise not prohibited from carrying a weapon, may carry a concealed weapon on campus so long as they have a Utah-issued provisional concealed carry permit or a concealed carry permit (CCP) issued by another state. Utah Code Ann. §§ 53-5a102.2 & 76-11-202.

May an individual carry their firearm on campus in an open manner?

Generally no. The only time most individuals may openly carry a firearm is when lawfully responding to an active threat. Utah Code Ann. § 76-11-205.5. On duty, local, state, and federal law enforcement officers may carry their weapons openly.

Are there locations on campus where firearms are not permitted?

Yes, all firearms are prohibited in the following areas:

  • Designated secure areas. Utah Code Ann. §§ 53H-3-902(5) and 76-8-311.1(2)(b)

May a student possess a firearm in their dorm room?

  • Yes, Utah law allows a resident who is 18 years or older to have a firearm in their dorm room. Utah Code Ann. § 53-5a-102.3.
  • Note: A student who does not wish to room with another student who has a firearm in their room may request a room change.

May an individual possess a firearm in their own vehicle on campus?

Yes, Utah law permits an individual to possess a firearm in their own vehicle while the vehicle is lawfully within their control. Utah Code Ann. § 76-11-205.5

Can I still carry a firearm openly on campus if I have a concealed carry permit?

No. Open carry is not allowed on campus. The law does establish that an individual who can lawfully conceal carry does not violate the open carry restrictions in these situations if one of the following applies:

  • The individual is lawfully responding to an active threat.
  • They are at their residence.
  • The open carry is approved by the responsible school administrator.

How are Firearms Laws Enforced on Campus?

The University takes an educational approach to the enforcement of firearms laws on campus. Anyone violating the laws will be asked by University police to comply.
